WFOLIO PHOTO AWARD 2026 OFFICIAL CONTEST TERMS AND CONDITIONS


1. GENERAL PROVISIONS

1.1. These Official Contest Terms and Conditions (the «Terms») govern the organisation and conduct of the photography contest known as «WFOLIO PHOTO AWARD 2026» (the «Contest»).

1.2. The Contest is organised by Wfolio Limited, Unit 1603, 16th Floor, The L. Plaza, 367–375 Queen’s Road Central, Sheung Wan, Hong Kong (the «Organiser», «Wfolio», «we», «us» or «our»).

1.3. The Organiser may engage third parties to assist with the technical, organisational, informational, promotional, judging, prize fulfilment or other aspects of the Contest, including partners, sponsors, contractors, judges, service providers, carriers and other third parties. Unless expressly stated otherwise by the Organiser, such third parties are not parties to any agreement between the Organiser and an Entrant.

1.4. The Contest is conducted online via the official Contest website wipa.pro (the «Website») and, where applicable, through Wfolio’s online platform, account system, submission tools and related services made available by the Organiser (the «Platform»).

1.5. The Contest period runs from 1 July 2026 to 14 November 2026, inclusive, UTC+3, unless different dates are published by the Organiser on the Website. The Contest period includes the submission period, judging, winner verification, announcement of results and initial prize administration. Actual use of the Grand Prix may occur after the Contest period and is subject to the Grand Prix Provider’s terms and availability.

1.6. The submission period for entries runs from 1 July 2026 to 30 September 2026, inclusive, UTC+3, unless different dates are published by the Organiser on the Website. Entries submitted after the end of the submission period will not be accepted, unless the Organiser expressly decides otherwise in its sole discretion.

1.7. Participation in the Contest is voluntary and free of charge. No purchase, payment or other consideration is required to enter or win. Any paid Wfolio subscription or paid platform feature is not a fee for entry into the Contest and is not required to participate in the Contest or to be selected as a winner. Each Entrant is solely responsible for any costs or expenses incurred in connection with participation in the Contest, including internet access, creation and submission of entries, documentation, taxes, duties, fees and other expenses.

1.8. The Contest is a skill-based creative competition judged on photographic and artistic merit. Winners are not selected by chance. The Contest is not a lottery, sweepstake, raffle, gambling activity, betting arrangement or other game of chance.

1.9. Participation in the Contest takes place through the Website and/or the Platform as specified by the Organiser. Account registration, use of the Website or Platform and processing of personal data are also governed by the documents made available by the Organiser, including the applicable Terms of Service and Privacy Policy. These Terms govern participation in the Contest, submission of entries, selection of winners, prize fulfilment and use of Contest entries in connection with the Contest.

1.10. By registering on the Website or Platform, submitting an entry to the Contest, clicking an acceptance button or otherwise taking part in the Contest, an Entrant fully and unconditionally accepts these Terms and enters into a binding electronic agreement with the Organiser.

1.11. Participation in the Contest does not create any employment, agency, partnership, joint venture, franchise, fiduciary, representative or similar relationship between an Entrant and the Organiser.

2. ELIGIBILITY

2.1. The Contest is open to individuals only. An individual may participate in the Contest as an entrant (an «Entrant») if they:

2.1.1. have a valid account on the Website and/or Platform, if such account is required by the Organiser for entry;

2.1.2. are at least 18 years old or have reached the age of majority under the laws of their country of residence, if such age is higher than 18;

2.1.3. are legally permitted to participate in the Contest under the laws of their country of residence, nationality and physical location;

2.1.4. submit their own original works in accordance with these Terms; and

2.1.5. are not subject to sanctions, restrictions, prohibitions or other measures that would prevent participation in the Contest, receipt of a prize, transfer of a prize, travel, delivery, payment, provision of services or interaction with the Organiser.

2.2. The Contest is open worldwide, except where participation, submission of an entry, receipt of a prize, transfer of a prize, travel, delivery or provision of services is prohibited or restricted by applicable law, sanctions, export control rules, banking or payment system rules, carrier rules, service provider rules, governmental requirements, Platform rules or the Organiser’s internal policies.

2.3. Each Entrant is solely responsible for determining whether their participation in the Contest, submission of an entry and receipt or use of any prize are permitted under the laws of their country of residence, nationality and physical location.

2.4. By participating in the Contest, each Entrant represents and warrants that they meet all eligibility requirements, that all information they provide is complete, accurate and current, that they have all rights, consents and permissions necessary to participate, and that they have the right to grant the rights set out in these Terms.

2.5. An Entrant may not transfer or assign any rights or obligations related to participation in the Contest without the Organiser’s prior written consent.

2.6. The Organiser may, but is not obliged to, verify an Entrant’s compliance with these Terms and request documents, information and confirmations relating to age, identity, authorship, rights, consents, permissions, place of residence, nationality, tax status, sanctions status and any other matters connected with participation in the Contest or receipt of a prize.

2.7. The Organiser’s failure to carry out any verification does not constitute confirmation that an Entrant is eligible, that an entry is lawful or original, that any rights, consents or permissions exist, or that the Entrant complies with these Terms.

2.8. Employees, officers, directors, contractors, judges and representatives of the Organiser, the Grand Prix Provider and any other persons directly involved in the organisation, administration or judging of the Contest, as well as their immediate family members and members of the same household, are not eligible to participate in the Contest or receive prizes, unless the Organiser expressly decides otherwise in writing.

3. HOW TO ENTER

3.1. To enter the Contest, an Entrant must, during the submission period specified in Section 1.6, submit through their personal account on the Website and/or Platform, in the applicable Contest section, their own works that comply with these Terms, select the applicable category and complete any other steps specified by the Organiser.

3.2. An Entrant may submit up to three entries per category, unless otherwise stated on the Website. The Organiser may allow a higher number of entries for certain users or categories, provided that such additional submission capacity does not constitute a payment for entry into the Contest, a guarantee of selection or a guarantee of any advantage in judging. The Organiser may make additional submission capacity available through platform functionality, promotional access or other methods determined by the Organiser. All entries are judged on their merits in accordance with these Terms.

3.3. Entries must have been created no earlier than 1 January 2020, unless otherwise provided in the rules of a specific category.

3.4. Unless otherwise stated by the Organiser on the Website, the minimum technical requirement for each entry is at least 1,500 pixels on the shorter side.

3.5. Upon request by the Organiser, an Entrant must, within three calendar days or within such other period as may be specified by the Organiser, provide source files, RAW files, EXIF data, metadata, contact sheets, image sequences, agreements, releases, consents, permissions and any other materials necessary to verify authorship, authenticity, method of creation, editing and lawful use of the entry.

3.6. Failure to provide the materials referred to in Section 3.5, or providing them late, incompletely or inaccurately, is an independent ground for rejection of an entry, removal of an entry, suspension of participation, disqualification, cancellation of results or refusal to award or deliver a prize.

3.7. Until the end of the submission period, an Entrant may remove a submitted entry from the Website and withdraw from participation in the Contest in respect of that entry. Such removal or withdrawal does not affect the Organiser’s right to use Contest-related materials that were created, published, distributed or prepared for publication before the removal or withdrawal.

3.8. The list of Contest categories, special category rules, technical requirements, judging criteria, deadlines and other Contest information will be published on the Website and form part of these Terms.

4. ENTRY REQUIREMENTS

4.1. Each Entrant may submit only works authored by that Entrant and in respect of which the Entrant is entitled to grant the rights set out in these Terms. Each Entrant is solely responsible for the legality of creating, editing, publishing and submitting their entry.

4.2. In all categories other than the category «AI-Generated Photography», entries must be photographs taken by the Entrant. Works that are wholly or predominantly created using generative artificial intelligence, CGI, synthetic imagery or similar technologies are not eligible for any category other than «AI-Generated Photography».

4.3. The Organiser may require disclosure of the use of artificial intelligence, CGI, retouching, manipulation, compositing, generative tools, substantial digital editing or any other method used to create or modify an image. Failure to provide complete, accurate and non-misleading disclosure is grounds for disqualification.

4.4. Entries must not:

4.4.1. contain material prohibited by law;

4.4.2. infringe any copyright, neighbouring right, moral right, property right, contractual right, confidentiality right, publicity right, reputation right, privacy right or other right of any third party;

4.4.3. contain defamatory, insulting, threatening, discriminatory or hateful material;

4.4.4. contain pornographic, obscene, excessively violent, shocking or otherwise unacceptable material, as determined by the Organiser in its sole discretion;

4.4.5. contain unlawful advertising, direct commercial solicitation, hidden advertising, political campaigning or material that violates Platform rules, Website rules or any other rules made available by the Organiser;

4.4.6. contain watermarks, logos, URLs, frames, advertising text or similar elements, unless expressly permitted by the Organiser;

4.4.7. mislead as to authorship, content, date, location, method of creation, editing or legal status of the entry; or

4.4.8. create legal, reputational, technical, commercial, sanctions-related or other risks for the Organiser, its affiliates, partners, contractors, judges or hosting platforms.

4.5. Each Entrant is solely responsible for obtaining all rights, consents, releases and permissions required in respect of depicted persons, including minors, objects, trademarks, works of art, private property, locations, events, personal data and any other protected objects or materials.

4.6. If an entry depicts minors, the Entrant represents and warrants that all consents of parents, guardians or other legal representatives have been obtained where required.

4.7. The Organiser may remove, reject, suspend, exclude or disqualify any entry, cancel any result or disqualify any Entrant if the entry does not comply with these Terms, the rules of the selected category, the requirements of the Website or applicable law, or if the Organiser considers that the entry may create any legal, reputational, technical, commercial, sanctions-related or other risk for the Organiser or any third party.

5. ENTRANT WARRANTIES AND INDEMNITY

5.1. By submitting an entry to the Contest, each Entrant represents and warrants that:

5.1.1. they are the author of the entry and hold all rights necessary for its use in connection with the Contest;

5.1.2. the entry was created, edited, published and submitted lawfully;

5.1.3. the Entrant has obtained all necessary rights, releases, consents and permissions from third parties;

5.1.4. the Organiser’s use of the entry as contemplated by these Terms will not infringe any third-party rights or applicable law;

5.1.5. all information provided by the Entrant in connection with the Contest is complete, accurate, current and not misleading;

5.1.6. the Entrant has not used any third-party materials without permission and has not breached these Terms; and

5.1.7. the Entrant’s participation, submission of the entry, receipt and use of any prize do not violate applicable law, sanctions, export controls, third-party rules or the Organiser’s internal policies.

5.2. If any claim, demand, action, complaint, request, fine, penalty, sanction or proceeding is brought against the Organiser, its affiliates, partners, judges, contractors, hosting platforms, media outlets, service providers, the Grand Prix Provider, prize providers or other persons involved in the Contest in connection with an Entrant’s entry, participation, acts, omissions, breach of these Terms, breach of warranties or violation of law, the Entrant must handle and resolve such matter at their own expense and indemnify and hold harmless the Organiser from and against all losses, damages, liabilities, costs, expenses, payments, compensation, fines, penalties, sanctions, reasonable legal fees and other costs arising from or relating to such matter, to the maximum extent permitted by applicable law.

5.3. Upon receipt of any claim, complaint, request or suspicion relating to an entry or Entrant, the Organiser may immediately remove the entry from the Contest, restrict its display, suspend participation, cancel results, refuse to award or deliver a prize or disqualify the Entrant without prior notice and without any obligation to disclose details of the review, evidence, third-party complaints, internal communications or reasons for the decision.

6. WINNER SELECTION

6.1. Winners of the Contest will be selected by the Contest jury.

6.2. Unless a different date is published by the Organiser on the Website, the jury will select the winners in all categories by 1 November 2026, UTC+3. The period following winner selection may be used by the Organiser for winner verification, announcement of results, prize administration, publication of Contest materials and other actions related to completion of the Contest. Prize fulfilment and actual use of any prize may be subject to additional timelines, third-party provider conditions and winner compliance with these Terms.

6.3. First, second and third places may be awarded in each category. The Organiser may decide not to award one or more places if, in the opinion of the Organiser or the jury, the submitted entries do not meet the level, requirements or objectives of the Contest.

6.4. From among the Entrants who receive first place in the categories, the jury may additionally select one Grand Prix winner.

6.5. The jury may evaluate entries based on criteria including artistic quality, originality, composition, technical execution, relevance to the category, overall impression and any other criteria the Organiser or the jury considers appropriate.

6.6. The process for judging, shortlisting, voting and selecting winners will be determined by the Organiser and the jury. The Organiser may modify technical, organisational and procedural aspects of judging without additional notice to Entrants, provided that such changes do not alter the general nature of the Contest as a skill-based creative competition.

6.7. The Organiser will announce the winners on the official Contest page and may also publish information about winners on social media, on the websites and online resources of the Organiser, partners and jury members, in newsletters, publications, press materials, catalogues, selections and other Contest-related materials.

6.8. The Organiser is not required to disclose judging methodology, scores, comments, protocols, correspondence, voting breakdowns, reasons for acceptance or rejection, internal materials of the jury or the Organiser, or any other information relating to the judging or decision-making process.

6.9. The composition of the jury will be published on the Website. The Organiser may change the composition of the jury, replace jury members, engage additional experts or refrain from disclosing certain technical participants in the judging process if the Organiser considers this necessary or appropriate.

6.10. The Organiser may submit entries for judging without indicating the author’s name, but does not guarantee complete anonymity at all stages of the Contest.

6.11. Decisions of the jury and the Organiser on admission of entries, selection of finalists, selection of winners, award of prizes, disqualification and any other Contest-related matters are final, binding and not subject to appeal or review within the Contest.

7. PRIZES

7. Winners who receive first, second and third place in each category will receive commemorative medals and Wfolio.com subscription prizes provided by the Organiser, unless otherwise stated by the Organiser on the Website.

7.2. The Grand Prix winner, being the participant who receives the highest total number of points following evaluation by all members of the jury, will receive the main prize: a travel prize package provided by an independent third-party provider operating under or represented by the brand name Moretime Expeditions, available at moretime-expeditions.com/ (the «Grand Prix Provider»). The Organiser is not the provider, operator, seller, organiser or guarantor of the Grand Prix and is not responsible for the acts, omissions, services, statements, terms, policies or activities of the Grand Prix Provider, except to the extent such responsibility cannot be excluded under applicable law.   

7.3. The composition, value, timing, itinerary, providers, conditions of use, restrictions, booking rules, availability, participant requirements and other parameters of the Grand Prix are determined by the Grand Prix Provider. The Organiser may publish relevant information on the Website or communicate it to the winner, but such publication or communication does not make the Organiser a provider of travel, expedition, transport or other services.

7.4. The Grand Prix and any other prizes include only those elements that are expressly stated in writing by the Organiser or the Grand Prix Provider as being included in the relevant prize. Any services, expenses or elements not expressly stated in writing as included are excluded from the prize and must be arranged and paid for by the winner. Without limitation, unless expressly stated otherwise in writing, the prize does not include visas, insurance, taxes, duties, transfers, meals, equipment, baggage, medical documents, personal expenses, optional activities or expenses of any companion.

7.5. The Organiser is not a tour operator, travel agent, carrier, hotel, insurer, visa consultant, expedition organiser or provider of travel, transport, accommodation, insurance, visa or other ancillary services in relation to the Grand Prix.

7.6. The Grand Prix is provided by the Grand Prix Provider subject to the terms, rules, restrictions, safety requirements, cancellation rules, rescheduling rules, medical requirements, age requirements and other conditions established by the Grand Prix Provider and applicable third parties.

7.7. The Organiser is not responsible for any act, omission, statement, warranty, service, service quality, safety, suitability, availability, cancellation, rescheduling, itinerary change, timing change, refusal to provide services, error, delay, requirement, restriction or other circumstance relating to the Grand Prix Provider, carriers, vessels, crew, tour operators, local hosts, hotels, insurers, visa authorities, governmental authorities, contractors or any other third parties connected with the Grand Prix. The Organiser is not responsible for the completeness, accuracy, currency or change of any information provided by the Grand Prix Provider or any other third party.

7.8. The Organiser is not responsible for any inability to receive or use the Grand Prix where such inability is connected with the rules, decisions, acts or omissions of the Grand Prix Provider or other third parties, including cancellation or rescheduling of an expedition, lack of availability, weather conditions, ice conditions, safety restrictions, medical requirements, documentation requirements, visa restrictions, border control, sanitary restrictions, sanctions, acts of governmental authorities or other circumstances outside the Organiser’s reasonable control.

7.9. The Organiser intends to complete initial prize administration by 14 November 2026 or within such other period as may be determined by the Organiser. For the purposes of these Terms, initial prize administration may include winner verification, contacting winners, requesting information or documents, confirming prize eligibility and taking reasonable steps to initiate prize fulfilment. Actual delivery, booking or use of any prize, including the Grand Prix, may occur after 14 November 2026 and is subject to these Terms, the Grand Prix Provider’s terms, conditions, requirements and availability, and any applicable third-party restrictions. The Organiser is not responsible for any inability to use the Grand Prix on specific dates or at all due to the Grand Prix Provider’s conditions, third-party restrictions or circumstances outside the Organiser’s reasonable control.

7.10. Prizes are not exchangeable for cash, refundable, transferable, replaceable or compensable at the request of a winner. No cash alternative, refund, substitution, reimbursement or compensation will be provided if a winner is unable or unwilling to receive or use a prize, unless the Organiser expressly decides otherwise in writing.

7.11. The Organiser may substitute any prize with an equivalent or different prize at its discretion and without cash compensation if the original prize becomes unavailable, changes, is cancelled, becomes impossible or materially difficult to provide, becomes economically impracticable or if substitution is necessary for legal, technical, organisational, sanctions-related, reputational, financial or other reasons.

7.12. Prizes are provided «as is». To the maximum extent permitted by law, the Organiser makes no warranties regarding the quality, fitness, availability, safety, timing, itinerary, services, providers, carriers, accommodation, visa decisions, insurance or any other elements of a prize provided by third parties, including the Grand Prix Provider.

8. PRIZE CLAIM AND FULFILMENT

8.1. To receive a prize, a winner must, within 14 calendar days of the Organiser’s request, provide all information, documents and confirmations required for prize administration and fulfilment.

8.2. If a prize requires physical delivery, the winner must provide a correct delivery address, contact details and any other required information. The winner is responsible for the accuracy, completeness and currency of such information.

8.3. To receive and use the Grand Prix, which includes travel, the winner is solely responsible for obtaining and maintaining all documents and satisfying all requirements necessary to receive and use the prize, including a passport, visa, entry and exit permissions, insurance, medical documents, confirmation of medical fitness, compliance with the Grand Prix Provider’s safety, medical, age, conduct, equipment and participation requirements, consents, permissions, certificates, payment instruments and any other necessary documents, unless expressly stated otherwise by the Organiser in writing.

8.4. Inability to obtain a visa, enter or leave a country, obtain insurance, pass control procedures, satisfy medical, safety, conduct, equipment or participation requirements, use transport, obtain accommodation, participate in the trip or use any element of the Grand Prix is not a ground for compensation, substitution, extension of time or payment of a cash equivalent, unless the Organiser expressly decides otherwise in writing.

8.5. If a winner fails to provide requested information, documents or confirmations within the required time, provides inaccurate information, fails to respond to the Organiser, avoids prize administration, fails to comply with the Organiser’s requirements or is unable to receive the prize for any reason, the Organiser may treat this as a refusal of the prize.

8.6. If a winner refuses a prize, fails to comply with requirements, does not respond, is disqualified or cannot receive a prize, the Organiser may, but is not obliged to, select another winner, award the prize to the next eligible Entrant, substitute the prize, use the prize otherwise or not award the prize.

8.7. If delivery, award or use of a prize is impossible or materially difficult due to circumstances outside the Organiser’s control, including carrier restrictions, customs restrictions, visa requirements, sanitary restrictions, destination country restrictions, sanctions, inability to contact the winner, third-party actions, provider failures, cancellation of services, force majeure or other circumstances outside the Organiser’s reasonable control, the Organiser may change the time, method or procedure for award or delivery, or deem the prize impossible to award, without compensation to the winner.

8.8. The Organiser may pay for standard delivery of a physical prize using a method selected by the Organiser, unless otherwise stated on the Website. All additional, repeated, expedited, customs, brokerage, storage, tax and other costs are borne by the winner.

8.9. All taxes, duties, fees, customs payments, mandatory withholdings, document costs, visa costs, insurance costs, medical document costs, transfers, meals, accommodation beyond what is expressly included, baggage, communications, personal expenses and any other mandatory or ancillary expenses connected with receipt, delivery or use of a prize are borne solely by the winner, unless expressly stated otherwise by the Organiser.

8.10. The Organiser is not required to compensate, withhold, reimburse or gross up any prize for taxes, duties, fees or other mandatory payments of the winner, unless such obligation is expressly imposed by applicable law.

8.11. The winner uses the Grand Prix and any travel, expedition, transport, accommodation or other related element of the prize at their own risk. To the maximum extent permitted by law, the Organiser is not responsible for harm to life or health, injuries, illness, death, delays, cancellations, rescheduling, itinerary changes, weather conditions, ice conditions, maritime risks, refusal of entry or exit, acts or omissions of the Grand Prix Provider, carriers, vessels, crew, hotels, tour operators, visa authorities, insurers, governmental authorities, contractors or other third parties. The winner is solely responsible for assessing whether they are physically, medically and otherwise able to participate in the Grand Prix.

8.12. If the Organiser cannot contact a winner using the contact details provided during registration or participation in the Contest within 14 calendar days of the first attempted contact, the Organiser may deem that winner to have refused the prize.

9. USE OF CONTEST ENTRIES

9.1. By uploading an entry to the Contest, each Entrant grants the Organiser a non-exclusive, royalty-free, worldwide licence to use the entry for the purposes of organising, conducting, administering, judging, moderating, announcing, covering, archiving, publishing, promoting and advertising the Contest and the Organiser’s Contest-related activities.

9.2. The licence is granted for the full term of copyright protection, is royalty-free, worldwide, non-exclusive and sublicensable within the purposes set out in these Terms, and is irrevocable in respect of materials already created, published, distributed, transferred to third parties or prepared for publication.

9.3. The licence includes all uses necessary for the conduct, administration, judging, publication, promotion, archiving and coverage of the Contest, including reproduction, publication, posting, communication to the public, public display, inclusion in informational, editorial, advertising, presentation, press and promotional materials, catalogues, selections, Website pages, social media, newsletters and other Contest-related materials.

9.4. The Organiser may technically process an entry, including by resizing, reformatting, changing resolution, cropping, compressing, adapting for interfaces, adding service elements, formatting for publication and performing other technical actions necessary for placement, promotion and coverage of the Contest, without materially changing the substance of the work.

9.5. The Organiser may grant sublicences and instruct third parties to use entries solely for the purposes of organising, conducting, administering, judging, publishing, promoting, archiving and covering the Contest.

9.6. An entry may be used with or without the author’s name or pseudonym, unless prohibited by law.

9.7. To the extent permitted by law, each Entrant agrees that the entry may be used without separate approval, without prior review, without remuneration and without additional consent.

9.8. The sale of Entrants’ Contest entries and the granting of independent commercial licences to third parties for use outside the purposes of the Contest are not permitted without the Entrant’s separate written consent.

9.9. If an Entrant removes an entry after submitting it to the Contest or withdraws from participation, this does not affect the Organiser’s right to use Contest-related materials that were created, published, distributed, transferred to third parties or prepared for publication before such removal or withdrawal.

10. PUBLICITY AND PERSONAL DATA

10.1. Each Entrant understands that, for participation, verification, moderation, judging, announcement of results, communications, prize delivery, organisation of the Grand Prix and performance of these Terms, the Organiser may process the Entrant’s personal data in accordance with the Organiser’s Privacy Policy. The Privacy Policy forms part of the documents applicable to participation in the Contest and is made available on the Website.

10.2. The Organiser may disclose necessary data of an Entrant or winner to service providers, contractors, partners, carriers, delivery services, payment, legal, tax, visa, travel, insurance, accommodation and other service providers to the extent necessary for the conduct of the Contest, verification, award or use of a prize. In relation to the Grand Prix, such data may be disclosed to the Grand Prix Provider, including Moretime Expeditions, and to any other persons necessary for the organisation or use of the Grand Prix. Such recipients may be located outside the Entrant’s country of residence, and the Entrant acknowledges that the Organiser does not control the independent data processing practices of third-party providers except where required by applicable law.

10.3. A winner agrees that the Organiser may publish the winner’s name, pseudonym, country, city, image, biographical information, title and description of the entry, Contest entry, interviews, comments and other information connected with winning the Contest in Contest-related materials without additional consent or remuneration, unless prohibited by law.

10.4. Each Entrant must provide only accurate and current personal data. The Organiser is not responsible for any inability to contact, deliver, verify, award a prize or perform any other act if the Entrant has provided incomplete, inaccurate, outdated or false information.

11. DISQUALIFICATION AND CHANGES TO THE CONTEST

11.1. The Organiser may disqualify an Entrant, remove an entry, reject an entry, suspend participation, cancel a result or refuse to award or deliver a prize if:

11.1.1. the Entrant breaches these Terms;

11.1.2. the Entrant provides inaccurate, incomplete, outdated or misleading information;

11.1.3. the Entrant fails to confirm authorship, rights, consents, permissions, age, identity, place of residence, sanctions status or any other circumstances requested by the Organiser;

11.1.4. the Entrant engages in abuse, fraud, manipulation of the Contest process, technical circumvention, mass uploads, bad faith conduct or attempts to influence Contest results;

11.1.5. the entry infringes third-party rights, applicable law, platform rules or these Terms;

11.1.6. the Entrant’s participation or award of a prize becomes unlawful, impossible, materially difficult, economically impracticable or risky for the Organiser; or

11.1.7. the Organiser considers that the entry, Entrant, publication, win or prize fulfilment may create legal, sanctions-related, tax, reputational, technical, commercial, financial or other risks for the Organiser or any third party.

11.2. The Organiser may at any time amend, supplement, suspend, extend, shorten or cancel the Contest, any stage, category, criteria, jury composition, deadline, prize, judging process, prize fulfilment process or other Contest condition if the Organiser considers this necessary or appropriate, including due to technical, legal, organisational, reputational, sanctions-related, financial, tax, commercial or other risks.

11.3. The current version of these Terms will be published on the Website. Continued participation in the Contest after publication of changes constitutes acceptance of such changes.

11.4. The Organiser may refuse admission, remove an entry, disqualify an Entrant, cancel a result or refuse to award or deliver a prize without any obligation to disclose details of verification, evidence, third-party complaints, internal communications, judging methodology or reasons for its decision.

12. WEBSITE, TECHNICAL FAILURES AND LIMITATION OF LIABILITY

12.1. The Website, Platform, submission forms, Contest pages, Contest materials and related services are provided «as is» and «as available». The Organiser does not warrant uninterrupted, error-free, secure or continuous availability of the Website or Platform, preservation of uploaded files, compatibility with the Entrant’s devices, absence of errors, viruses, failures or delays, or successful transmission of data.

12.2. Each Entrant is solely responsible for keeping copies of all submitted entries, source files, metadata, consents, permissions and other materials. The Organiser is not responsible for loss, damage, distortion, unavailability, delayed upload, deletion or non-receipt of files, submissions, metadata or other materials.

12.3. The Organiser is not responsible for:

12.3.1. technical failures, data transmission errors, interruptions in the operation of the internet, hosting, email services, platforms, social networks, payment systems, communication services or other third-party services;

12.3.2. inability to participate in the Contest for reasons outside the Organiser’s control;

12.3.3. any act, omission, delay, error, cancellation, refusal or other circumstance connected with the Grand Prix Provider, partners, carriers, courier services, visa centres, governmental authorities, travel-related service providers, media platforms, communication services, hosting providers, banks, payment systems, insurers, hotels, tour operators or other third parties;

12.3.4. inability to receive, deliver or use a prize due to the winner’s acts or circumstances outside the Organiser’s control;

12.3.5. consequences of incomplete, inaccurate, outdated or erroneous information provided by an Entrant;

12.3.6. third-party claims connected with an Entrant’s works, infringement of rights, absence of consents, unlawful shooting, editing, publication or submission of an entry; or

12.3.7. indirect, incidental, punitive, special or consequential losses or damages, loss of profit, loss of data, reputational harm, loss of opportunity, inability to participate, inability to win or inability to use a prize.

12.4. To the maximum extent permitted by applicable law, the Organiser’s aggregate liability for any and all claims arising out of or in connection with the Contest is limited to HKD 100. In the case of a claim by a winner relating directly to a prize actually received by that winner, the Organiser’s aggregate liability will not exceed the lower of HKD 100 or the value of the prize actually received by that winner.

12.5. Nothing in these Terms excludes or limits the Organiser’s liability to the extent such exclusion or limitation is expressly prohibited by applicable law.

12.6. The Organiser is not responsible for any full or partial failure to perform its obligations under these Terms if such failure is caused by force majeure or any other circumstances outside the Organiser’s reasonable control, including natural disasters, fires, floods, war, civil unrest, terrorist acts, epidemics, pandemics, acts of governmental authorities, sanctions, export restrictions, disruptions to transport, financial, travel, digital or communications infrastructure, provider failures, changes in law, court or governmental decisions, or any other circumstances outside the Organiser’s control.

13. GOVERNING LAW AND DISPUTES

13.1. These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, without regard to conflict of laws rules.

13.2. Any dispute, controversy or claim arising out of or in connection with these Terms or the Contest is subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region of the People’s Republic of China, unless another procedure is expressly required by applicable law.

13.3. To the extent permitted by applicable law, each Entrant waives any right to participate in any class, collective, representative or consolidated action against the Organiser.

13.4. If any provision of these Terms is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not be affected. The invalid, illegal or unenforceable provision will be deemed replaced by a valid, legal and enforceable provision that most closely reflects the original intent and commercial purpose.

13.5. The official and controlling version of these Terms is the version published by the Organiser on the Website. The Organiser may update, replace or remove previous versions of these Terms at its discretion, subject to applicable law.

13.6. If these Terms are made available in more than one language, the English version will prevail in the event of any inconsistency or discrepancy between language versions, unless the Organiser expressly states otherwise on the Website.

13.7. Any delay, failure or waiver by the Organiser in exercising any right under these Terms does not constitute a waiver of that right and does not prevent the Organiser from relying on that right or breach at a later time.

13.8. The provisions relating to rights in entries, warranties, indemnity, limitation of liability, disclaimers, governing law, disputes, taxes, sanctions, use of data, winner publicity, prize restrictions and third-party provider responsibility survive the end of the Contest, removal of an entry, withdrawal from participation, disqualification, award, non-award, receipt or non-receipt of a prize.
